1.1 The subject of the following contract ("Contract"), stipulated after the agreement described in the paragraph 2 by Edizioni Corpo Mente Spirito snc, by Piacenza Vittorio and Iallonardi Christian ("Edizioni CMS"), with registered office in corso Nizza 41, Cuneo (CN) Italy, is the supply of publishing products, both in digital and paper form, (the "Products"), as indicated on the website named Edizioni Corpo Mente Spirito" (from now on, "Edizioni CMS").
The supply of these Products will take place, when purchased, by the specified time and means decided by any natural or legal person ("User") which, after the correct registration of personal data (the "Data") and payment of the amount due, as described in paragraph 3, has filled in and sent to "Edizioni CMS" the appropriate Order Form on the website, after clicking the buttons situated at the bottom of the indicated web pages.
The Order Form will clearly report, at the end of the ordering procedure, the total amount due for the chosen Products, including the shipping costs to the place indicated by the User.
1.2 Edizioni CMS will send the Products to the place indicated by the User. Edizioni CMS is allowed to modify sending conditions anytime and in its sole discretion, after giving notice of that on the website Edizioni CMS.
2. Effectiveness - Withdrawal
2.1 The Contract will be valid from the day (the "Effective date") in which Edizioni CMS, after the acknowledgement of the payment of the amount due by the User, who has correctly registered his data, will send the Products. To allow this, Edizioni CMS and the User acknowledge that the supply of the Products by Edizioni CMS will result in the agreement of the User's proposal, which, regardless from the correct fulfillment by the User of the previsions contained in the present paragraph 2.1, Edizioni CMS could decide not to accept, in its sole discretion.
2.2 The User can withdraw the Contract, according to the d.lgs. n. 185/1999, within 10 (ten) working days from having sent the Order Form, by the submission of a written communication to Edizioni CMS, by registered letter with return receipt containing (a) the clear will of availing himself of the withdrawal right, (b) the description of the purchased Products, (c) the exact date in which the User sent the Order Form. The withdrawal right is not valid for sealed audio/video Products which the User has opened;
In this case, the User will send to Edizioni CMS the Products, at his own expenses, correctly sealed in their original package, with an insured package within 10 (ten) days from the receipt of the Products.
Only when the foretold conditions are followed, the User can receive the refund of the price of the Products purchased from Edizioni CMS. The refund will be completed within 30 (thirty) days after the restitution of the Products, and it will consist in the price of the Products as shown in the Order Form, without shipping costs.
3. Payments and Terms of payment
The User will give to Edizioni CMS, as payment for the supply of Products and related shipping costs, only the price indicated in the Order From at the moment of the purchasing. Payment may be made by credit card (American Express, Mastercard, Visa), bank transfer or postal current account transfer.
Notwithstanding the foregoing, Edizioni CMS reserves the right to modify in any moment the price of the Products on the website Edizioni CMS.
4. Failure to payment - Interruption and termination of supply
The User hereby acknowledge that, in case of failure to payment, after the check made by the payment system, Edizioni CMS reserves the right to interrupt and/or terminate the Product supply. Edizioni CMS has the right to activate, within the limits consented by the Italian law, procedures and human resources, internal and/or external to the company, in order to recover the failed payments and other costs related to publishing products described in the catalogue.
Any communication related to the present Contract, will be make by the User by e-mail and will be valid and effective when received on the following address of Edizioni CMS: "email@example.com".
6. Applicable law - Disputes
6.1 This Contract shall be subjected to the Italian law. If any individual clause contained in it is void or invalid, this will not result in the other clauses to become void or invalid, which will be considered fully valid and effective.
6.2 Exept as provided by article 1469 bis, third comma, nr. 19 of the Civil Code, jurisdiction for any dispute that should arise between the parties in relation to this Contract, including disputes about its interpretation, stipulation, execution, juridical existence, validity and invalidity, withdrawal and resoultion, is assigned to the Court of Cuneo.
Approval in accordance with articles 1341 and 1342 of the Civil Code.
Within the meaning of articles 1341 and 1342 of the Civil Code, I declare to have carefully read and examined all the clauses and conditions contained in this Contract, to accept and approve specifically the following disposition 1, 2, 3, 4, 5, 6.
